Terms of service

DRAFT FOR REVIEW · Placeholders in [BRACKETS] to be completed · Last updated [DATE]

1. Scope of service

Carelabel provides an automated pre-check of apparel care labels against published textile labeling rules, and, as a paid service, corrected print-ready label files, compliance documentation, and check certificates. Every check is a labeling check based on the product data you confirm. It is not legal advice, and it is not a customs or product-safety inspection. Responsibility for the accuracy of product information remains with the party placing the product on the market.

2. Contracting party

The contract is concluded with [COMPANY LEGAL NAME], [REGISTERED ADDRESS] (“we”, “us”). The service is directed at businesses ([CONFIRM B2B-ONLY OR CONSUMER SCOPE]).

3. The free check

The free check produces an automated preliminary result. It reveals the number, severity, and legal area of detected issues and the first issue in full. We may limit, change, or discontinue the free check at any time.

4. Paid services and conclusion of contract

Paid services (corrected label file, certificate, bundles) are described on the result page at the time of order. The contract is concluded when we confirm your order by email. Prices are stated in euros; [VAT TREATMENT].

5. Your obligations

Our deliverables are built from the product data you provide and confirm (fiber composition, origin, manufacturer details, and similar). You are responsible for the accuracy and completeness of this data. Delivery requires your confirmation of the product data on your status page.

6. Correction guarantee

If a label we created is objected to by an authority or a court, we correct it free of charge and refund the order price. Every check is based on the product data you confirmed. Liability is limited to the order value; the remainder of this section and section 8 apply.

7. Delivery and re-checks

Deliverables are provided digitally via your status page and by email. Paid orders include re-checks until the report shows no findings, based on the same confirmed product data.

8. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For slight negligence we are liable only for breach of essential contractual duties, limited to the foreseeable damage typical for this type of contract, and capped at the order value. [ALIGN LIABILITY CLAUSE WITH GOVERNING LAW]

9. Intellectual property

You receive the right to use delivered label files for your own products without limitation. The underlying rule engine, templates, and website content remain our property.

10. Certificates and verification

Certificates document the checked label state at the time of issue, identified by a check ID and rule version, and can be verified online. A certificate does not guarantee future compliance if rules or your product data change.

11. Governing law and jurisdiction

These terms are governed by the law of [JURISDICTION], excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is [PLACE OF JURISDICTION], where legally permissible.

12. Changes to these terms

We may change these terms for the future with reasonable notice. The version in force at the time of your order applies to that order.
